UAE Emiratisation: Who is a ‘skilled’ employee?

UAE companies must achieve the country’s Emiratisation target before January 1, 2023

UAE’s Ministry of Human Resources and Emiratisation (MoHRE) announced its aim of increasing the rate of Emirati employees by 2 percent in the private sector companies with more than 50 employees, is conditional to employing them in skilled jobs, this year.

However, the Ministry also affirmed that it was “closely monitoring the Emiratisation-related procedures” especially on the types of jobs they are offering to UAE nationals.

“We stress that for companies to achieve the Emiratisation targets, it is necessary that they employ Emiratis in skilled job,” the ministry said in its official Twitter account on December 07.

“By January 2023, non-compliant companies that fail to achieve the Emiratisation targets will face fines” the ministry added.

What is the skilled employee category?

MoHRE has listed out nine professional levels according to the International Standard Classification of Occupations (ISCO) issued by the International Labour Organisation, classifying skilled employment. Of the nine, five levels fall under the skilled employee category.

The nine levels are as follows:

  • Level 1: Legislators, managers, and business executives
  • Level 2: Professionals in scientific, technical and human fields
  • Level 3: Technicians in scientific, technical and humanitarian fields
  • Level 4: Writing professionals
  • Level 5: Service and sales occupations
  • Level 6: Skilled workers in agriculture, fisheries and animal husbandry
  • Level 7: Craftsmen in construction, mining, and other craftsmen
  • Level 8: Operators and assemblers of machinery and equipment
  • Level 9: Simple professions

According to the UAE government’s official website, a skilled employee can also be classified as someone:

  • who is employed at a professional level – which is from skill level 1 to 5.
  • who has a certificate higher than a secondary certificate or an equivalent certificate, attested by competent authorities in the UAE.
  • who has a monthly salary (excluding commission) of the worker must not be less than AED 4,000

Companies failing to achieve the UAE’s Emiratisation targets within the next 10 days, will face fines of $20k (AED72,000) per year for every Emirati not hired.

Firms that fail to meet the targets will be fined at a rate of AED6,000 a month or AED72,000 a year.
